Minimum terms

Offense Minimum jail term If committed in the presence of a child under 16 who is a family or household member
First 10 days 15 days
Second 15 days 20 days

The minimum does not apply if the court sentences the person to a nonsuspended period of incarceration in a state correctional facility. The section does not prevent the court from also imposing probation, community control, or a longer period of incarceration.
