What this section covers

Section 943.045 is a list of definitions used in the part of chapter 943 that deals with criminal justice information. It does not itself set eligibility rules or create the certificate of eligibility. Those are in sections 943.0585 (expunction) and 943.059 (sealing).

Two definitions people look for

  • Expunction of a criminal history record means the court-ordered physical destruction or obliteration of a record or a portion of a record by the criminal justice agency that holds it.
  • Sealing of a criminal history record means the preservation of a record under circumstances in which it is secure and inaccessible to anyone who does not have a legal right of access to it.
